Privacy Policy

1. Introduction and Scope

This Privacy Policy explains how Core Group Company LLC, doing business as "MarqTools" ("MarqTools," "we," "us," or "our"), collects, uses, discloses, and protects information in two contexts:

  • Website Visitors: individuals who interact with the MarqTools AI chat agent (the "Agent") embedded as a widget on a customer's website (a "Customer Website"); and
  • Site Visitors: individuals who visit marqtools.com directly.

This Policy applies to Website Visitors and Site Visitors. It does not govern the separate contractual relationship between MarqTools and the businesses that subscribe to the Service (each, a "Customer") — that relationship is governed by the MarqTools Terms and Conditions. If you are a Customer, references to "you" in the Terms and Conditions (not this Policy) describe your rights and obligations as a subscriber.

Because Website Visitors interact with the Agent on a Customer's own website and are not party to the Terms and Conditions between MarqTools and that Customer, this Policy is the document that governs how MarqTools handles Website Visitor information.

2. Information We Collect

2.1 Information From Chat Interactions

When a Website Visitor uses the Agent, we collect the content of the messages the visitor sends, the Agent's generated responses, timestamps, and session identifiers. We do not require a Website Visitor to log in or provide an account to chat with the Agent, but a visitor may voluntarily share personal information (such as a name, email address, or phone number) in the course of a conversation, for example to request a callback or quote.

2.2 Information Collected Automatically

We and our infrastructure providers automatically collect certain technical information when the Agent widget loads or a visitor interacts with it, including IP address, browser type and version, device type, referring URL, pages viewed, session duration, and server and error logs.

2.3 Cookies and Similar Technologies

The Agent widget may use cookies, local session identifiers, or similar technologies to maintain conversation continuity within a session and to support basic security and analytics functions. These are not used to build cross-site advertising profiles, and we do not permit third-party advertising cookies to be set through the widget.

3. How We Use Information

  • Operating the Agent: retrieving relevant knowledge base content and generating conversational responses to a visitor's questions;
  • Service improvement: analyzing aggregated and anonymized usage patterns to improve Agent performance and reliability;
  • Security: detecting and preventing fraud, abuse, spam, and security incidents;
  • Support to the Customer: making chat transcripts available to the Customer whose website the visitor was using, so that Customer can follow up on inquiries;
  • Legal compliance: meeting our legal, tax, and regulatory obligations.
No AI Training on Visitor Data. MarqTools does not use chat messages, Agent responses, or other Website Visitor content to train, fine-tune, or otherwise improve any artificial intelligence or machine learning model, whether ours or a third party's.

4. How We Share Information

We do not sell Website Visitor or Site Visitor personal information. We share information only as follows:

  • The Customer whose website you were using: chat transcripts and related interaction data are made available to that Customer, since the Agent is deployed on their behalf and they need this information to respond to inquiries;
  • Third-party AI providers: to generate Agent responses. These providers process the data to return a response and do not retain it for model training (see Section 2.1 of the MarqTools Terms and Conditions);
  • Cloud hosting providers: for secure infrastructure and data storage, encrypted in transit and at rest;
  • Payment and email service providers: solely in connection with the Customer relationship, not typically involving Website Visitor personal information;
  • As required by law, to enforce our agreements, or in connection with a merger, acquisition, or sale of assets, with notice where practicable.

5. Data Retention

  • Chat logs (Website Visitor conversations and Agent responses) are retained on a 90-day rolling basis.
  • Technical and server logs are retained for a limited period consistent with security and diagnostic needs, generally no longer than 90 days.
  • Voluntarily provided contact information (e.g., name or email shared during a conversation) may be retained by the Customer independently of MarqTools's retention schedule, subject to the Customer's own privacy practices.

6. Your Privacy Rights

6.1 California Residents

If you are a California resident, applicable law may give you the right to know what personal information we have collected about you, to request deletion of that information, to correct inaccurate information, and to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined under California law. You may submit a rights request as described in Section 6.3 below.

6.2 EEA, UK, and Other Jurisdictions

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with similar data protection laws, you may have the right to access, correct, delete, or port your personal information, to object to or restrict certain processing, and to lodge a complaint with a supervisory authority. Where we rely on legitimate interests to process your information, you may object to that processing on grounds relating to your particular situation.

6.3 Submitting a Request

You may submit a privacy rights request, or ask a question about this Policy, by emailing contact@marqtools.com. Because Website Visitor chat data is associated with the Customer Website where the conversation occurred, please include the website domain and, if possible, approximate date and time of the conversation so we can locate the relevant records. We may need to verify your identity before completing certain requests.

7. Children's Privacy

The Service is not directed to children, and we do not knowingly collect personal information from children under 13 (or the applicable age of digital consent in your jurisdiction) through the Agent. If you believe a child has provided personal information through the Agent, please contact us at contact@marqtools.com and we will take appropriate steps to delete it.

8. International Data Transfers

MarqTools and its infrastructure and AI providers may process and store information in the United States and other countries. Where required by applicable law, we implement appropriate safeguards for cross-border transfers of personal information.

9. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards, including encryption in transit (TLS 1.2+) and at rest, role-based access controls, and continuous monitoring. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Relationship to the MarqTools Terms and Conditions

This Policy supplements, and should be read alongside, the MarqTools Terms and Conditions, which govern the contractual relationship between MarqTools and its Customers. In the event of a conflict specifically regarding the handling of Website Visitor information, this Policy controls. Customers remain responsible for providing their own website visitors with adequate notice of, and where required by law, obtaining consent to, the Agent's collection of visitor information, in addition to anything MarqTools does under this Policy.

11. Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. We will post the updated Policy at this URL and update the "Last Updated" date above. Material changes will be communicated to Customers in accordance with the notice provisions of the Terms and Conditions, which Customers are responsible for passing along to their website visitors where appropriate.
